Terms and conditions of use of the Tasmanian Government free Wi-Fi network (“conditions of use”)

By clicking on “I agree” you confirm you have read, understood, accept and agree to these terms and conditions of use governing your access to the Tasmanian Government free Wi-Fi network (the Network).

Access to the Network is made available by the Crown in Right of Tasmania (Crown). The Crown may suspend or block your access to the Network if you breach these terms and conditions of use, entirely at its discretion.

Usage allocation

Upon connecting to the Network, your unique device IP address will be allocated 30 minutes of free internet access per device per day in each of the locations covered by the Tasmanian Government free Wi-Fi network before you are logged out.

While there is no download limit for users, bandwidth and concurrency limits will be applied to ensure a minimum user experience sufficient for browsing the internet, sending and receiving emails and accessing social media platforms. The Crown does not guarantee the Network will provide a continuous service that meets any performance standard.

Your connection will be terminated once the above allocation has been reached. You may log back into the Network with different devices in the same day, however, each device will only be allocated up to 30 minutes of free internet access per day in each of the locations covered by the Tasmanian Government free Wi-Fi network. If your connection is terminated, you will be unable to reconnect to the Network until the next calendar day.

Unlawful and inappropriate use

It is solely your responsibility to ensure that your use of computers, and other applicable devices and the Internet at all times comply with Australian and Tasmanian laws. You are also prohibited from engaging in activities which, while not unlawful, are considered inappropriate or unacceptable by the Tasmanian Government, entirely at its discretion.

Content filter solutions will be applied to protect you from exposure to against inappropriate material and to protect the Network from security risks posed by malicious software. You are also responsible for protecting yourself against viruses, misuse and damage with up-to-date protective software.

Access and security

You must not engage in any activity that may reasonably and foreseeably cause damage to the Crown's computer hardware or software or to anyone else's computer or network equipment. Precluded activities include, but are not limited to, the downloading, creation or transmission of messages, attachments, data files or software that contain a virus.

You must not attempt to gain unauthorised access to any information resources, systems or networks or interfere with another user's work or connection. System files, system configurations, folders and other technical data must not be altered.

Privacy

Email and the internet are not necessarily secure, and confidentiality may be compromised by unintended redistribution of email or by the inadequacy of current technologies to protect against unauthorised access. In using the Network you acknowledge it is not necessarily secure and you agree to exercise, and are responsible for exercising, caution in communicating personal or sensitive information via the Network.

Waiver of liability

The Crown restricts access to some material available via the internet, but does not accept any responsibility whatsoever for any illegal, offensive, indecent or otherwise harmful material accessed on the Network, nor for any loss or damage whatsoever and however arising or incurred from use of, or reliance on information obtained through its Network or in relation to the reliability or quality of the Network or any service accessed using the Network.

You understand and agree that you access and use the Network solely at your own discretion and risk, and that you will be solely responsible and liable for any damage or loss whatsoever that results or is incurred from such use. The Crown, its officers, employees and agents do not accept liability whatsoever and however arising, including liability for negligence, for any loss or damage resulting from any or all of the access to, use of or reliance upon the Network or reliance on the Network’s availability at any time.

The Crown is not responsible for individual devices, nor for configuring equipment for wireless connectivity, and cannot guarantee that you will be able to connect to the Network with your device. Businesses covered by Wi-Fi footprints under the Network do not provide power, information technology advice or assistance to any user of the Network.

Monitoring

The Crown has the lawful right to monitor your use of its equipment and may do so at any time without notice.

Management of infringements

If you are found engaging in activity contrary to the terms and conditions of use, or if you are suspected of engaging in activity contrary to law, you may be liable to prosecution.

Use by children

The Crown assumes parental permission has been given for children (under 18 years of age) to access the Network. 

General

These terms and conditions of use are governed by and construed in accordance with the laws of the State of Tasmania, which has exclusive jurisdiction over any disputes. If for any reason a court of competent jurisdiction finds any provision or portion of these terms and conditions of use to be unenforceable, the remainder of these terms and conditions of use will continue in full force and effect.
